Misuse Policy
Nitrous Oxide is a pressurised, colourless gas used within the catering and hospitality industry for food and beverage preparation. The product can be misused for its psychoactive effects or to ‘get a high’ by inhalation. It is only for sale to persons over the age of 18 years. By signing this form you (the purchaser) confirm you are over 18 and do not intend on supplying Nitrous Oxide to any persons under the age of 18.
Previously, Nitrous Oxide was subject to the Psychoactive Substances Act 2016 however from 8 November 2023, Nitrous Oxide shall be classified as a Class C drug under Schedule 5 of the Misuse of Drugs Act 1971 and possession of such will be deemed illegal if it is, or is likely to be, wrongfully inhaled. Wrongful inhalation constitutes all inhalation other than for medical or dental purposes, and which is not accidental inhalation of Nitrous Oxide which has been released into the atmosphere (such as in industrial processes). There is a requirement on suppliers to take appropriate steps to not be reckless, to ensure that subsequent users will not inhale the substance recreationally. By signing this form you acknowledge any conduct contrary to this may be deemed a criminal offence.
We would like to remind all customers of the potentially fatal consequences of abusing Nitrous Oxide and the dangerous effects of Nitrous Oxide abuse. Any attempt at self-medication with laughing gas could lead to immediate death by asphyxiation or at the very least there could be serious long-term side effects.
You must confirm that you are the named purchaser, are at least 18 years of age and understand that you will be committing an offence if you provide false information. As per the Misuse of Drugs Act 1971, it is a criminal offence to misuse Nitrous Oxide. If we suspect you intend on misusing the product, your order will be cancelled with immediate effect and your account will be reported to the police.

Consumer Declaration
I confirm that I am the named purchaser, I am over the age of 18 years old, and I am duly authorised to act on behalf of the company or trade stated below.
I confirm that I do not propose to misuse the goods or intend to supply the goods to anyone I believe (i) to intend to misuse these products or (ii) are under the age of 18 years old.
I confirm I am aware and understand that Nitrous Oxide is now a Class C Drug under the Misuse of Drugs Act 1971 and possession of this is illegal and deemed a criminal offence if it is, or is likely to be, wrongfully inhaled.
I confirm that I understand that the use of this product is strictly limited to legitimate and lawful purposes, and I agree to comply with the Misuse of Drugs Act 1971 and all applicable law and government guidance.
I am aware those found in unlawful possession will face either an unlimited fine, a visible community punishment or a caution – which would appear on their criminal record. Repeat serious offenders may face a prison sentence of up to two years, an unlimited fine, or both. The penalty for supply or production will double, to up to 14 years in prison, an unlimited fine, or both.
I confirm that should I plan to re-sell the goods, all required signage, labelling and/or information which relates to or accompanies the Goods shall make clear it is for catering and/or any other legitimate use only and does not suggest any form of misuse. I confirm I will not re-sell/deliver to suspicious locations including but not limited to hospitals, colleges and university locations unless legitimate use is duly verified and evidenced.
I confirm that as a retail re-seller I will take due diligence when re-selling Nitrous Oxide and will ensure all precautions are taken to ensure the safety of the general public and of the ‘end-user’. I will request age identification from any customers wishing to purchase Nitrous Oxide and undertake stringent due diligence to ensure that the products will not be misused. I will also ensure that any of my customers are subject to the same stringent terms and conditions that I am contracted to with the supplier.
I confirm that I will take all precautionary measures to monitor my online customers to ensure (a) that they are over the age of 18 years old and (b) that they are intending to use the Nitrous Oxide for legitimate purposes. I understand that as a re-seller or distributor, I may be committing a criminal offence should these goods recklessly fall into the wrong hands (ie. Minors or Misusers).
If I am deemed to have misused the goods or re-sold for misuse, I understand that my business relationship will be terminated and subjected to a blacklist database so that I will not be able to contract with the supplier again.
I understand that information may also be shared with the police should it be deemed appropriate for the protection of the public.
